The undersigned agrees and
understands that the following credit terms are a part of any sale. Each invoice is payable in full thirty days
after its
date. A service finance charge will be assessed
upon all unpaid balances which are more than thirty days old on the first day
of each calendar
month in the amount of $2.00
or 1.5% per month (18% per annum) which ever amount is higher. Goods sold may
be returned for credit only with
the consent of American
Building Services, and there will be a 25% restocking charge on all such
merchandise returned for credit. If American
Building Services takes any action
to collect any amount due to American Building Services, it will be entitled to
recover all expenses
incurred in connection with
such action whether or not suit is brought including, but not limited to
attorney’s fees, court costs, title searches,
minutes of foreclosure and
other expenses incurred in the connection with actions at law or in equity to
enforce any right or remedy American
Building Services may have.
The undersigned certifies
that all of the above information is true and correct and the undersigned fully
agrees to all of the above stated terms of
sale.

We, the undersigned, do
hereby jointly, severally and personally guarantee the above corporate
purchaser’s full performance of said purchase
agreement and hereby agree to
indemnify American Building Services against any and all damage, loss, expense
(including attorney’s fees)
and/or liability sustained by
American Building Services by reason of or related to, the above corporate
purchaser’s failure to perform or to pay
when due, charges incurred in
accordance with the above agreement.
American Building Services may enforce the agreement against the
undersigned or any of them, jointly or severally, whether or not any action is ever taken by it against the above Corporate Purchaser.
